يعتبر عقد المقاولة من العقود المهمة في الحياة العملية لتعلقه بحاجة الأفراد والمرافق العامة، وتنفيذ العقد يحكمه مبدأ العقد شريعة المتعاقدين، فيلتزم أطراف العلاقة التعاقدية بتنفيذ التزاماتهم المتفق عليها في العقد، وذلك في حالة الظروف الطبيعية، ولكن ظهرت جائحة كورونا والتي تسببت في شلل للحياة الطبيعية وتأثر الاقتصاد وأغلقت المحلات التجارية، وترتب على ذلك تأثر العقود المبرمة بين الأطراف، مما يجعل تنفيذ الالتزام على المقاول مرهقاً أو مستحيلاً ومضراً بأحدهما، فتتغير التزامات الأطراف إلى الحد المعقول الذي يرفع به الضرر، لإعادة التوازن العقدي، أو يفسخ العقد لمصلحة المتعاقدين، وذلك من قبل القاضي، وإذا حصل تأخير في تنفيذ العقد بسبب الجائحة فلا يصح إيقاع غرامة التأخير حينها، وسوف نتحدث في هذا البحث عن موضوع ( أثر جائحة كورونا على عقد المقاولة في النظام السعودي).

This is in the case of normal conditions, but the Corona pandemic appeared, which paralyzed normal life, affected the economy, and closed commercial, As a result, the contracts concluded between the parties are affected, making the implementation of the contractor’s obligation burdensome or impossible and harmful to one of them, so the obligations of the parties are changed to a reasonable extent that eliminates the damage, to restore the contractual balance, or the contract is terminated in the interest of the contracting parties, This is done by the judge, and if there is a delay in implementing the contract due to the pandemic, it is not permissible to impose a delay fine at that time. In this research, we will talk about the topic (the impact of the Corona pandemic on the contracting contract in the Saudi system).
